The full text of the "Regulations on the Food Safety Responsibility System for Local Party and Government Leaders" is as follows.

Chapter One   General Provisions

Article 1 In order to further implement the requirements for the responsibility of the party and government for food safety, strengthen the responsibility for territorial management of food safety, improve the responsibility system for food safety work, and ensure the people's "safety on the tip of the tongue", these regulations are formulated in accordance with relevant party regulations and national laws .

Article 2  The food safety mentioned in these regulations includes the quality safety of edible agricultural products.

The term "in charge of food safety work" as used in these regulations refers to work in charge of edible agricultural product quality and safety supervision and food safety supervision.

The food safety-related work mentioned in these regulations refers to the work closely related to food safety in industries or fields such as hygiene and health, ecological environment, food, education, politics and law, propaganda, civil affairs, construction, culture, tourism, transportation, etc., as well as work related to food safety. Provide support for work in the fields of development and reform, science and technology, industry and information technology, finance, and commerce.

Article 3   These regulations apply to members of local party committees and government leadership groups at and above the county level (hereinafter collectively referred to as local party and government leading cadres).

Article 4 To implement the food safety responsibility system for local party and government leaders, we must adhere to Xi Jinping’s new era of socialism with Chinese characteristics as the guidance, strengthen the "four consciousnesses", strengthen the "four confidences", and achieve the "two safeguards". Firmly establish a people-centered development concept, implement the "four most stringent" requirements for food safety, implement food safety strategies in depth, assume the political responsibility of "promoting development and ensuring safety of the other side", and continuously improve the level of food safety work , And strive to enhance the people's sense of gain, happiness, and security.

Article 5   The establishment of a responsibility system for local party and government leaders in food safety work shall follow the following principles:

(1) Adhere to the same responsibility of the party and government, double responsibilities of one post, consistent power and responsibility, joint management, negligence of responsibility, and due diligence;

(2) Persisting in the pursuit of development, safety must be sought, safety must be managed in the industry, and safety must be maintained to protect people's livelihood;

(3) Persist in the comprehensive use of assessment, reward, and punishment measures to supervise and urge local party and government leaders to perform food safety responsibilities, and ensure the implementation of the decision and deployment of the Party Central Committee and the State Council on food safety work.

Article 6 The local party committees and governments at all levels are responsible for the food safety work in the region. The main person in charge is the first person responsible for the food safety work in the region. Chapter Two   Responsibilities

Article 7: The main person in charge of local party committees at all levels shall comprehensively strengthen the party’s leadership over food safety work in the region, earnestly implement the Party Central Committee’s guidelines, policies, decision-making arrangements and instructions on food safety work, decisions of higher party committees, and relevant laws and regulations. , The main responsibilities include:

(1) Organize to study and implement the spirit of General Secretary Xi Jinping’s important instructions on food safety work and the Party Central Committee’s policies, decision-making and deployment on food safety work, continuously improve the political positions of local party and government leaders, and strengthen food safety work Sense of responsibility and mission;

(2) Comprehensively strengthen the party's leadership over food safety work in the region, and regard food safety work as an important content of the report to the plenary meeting of the party committee;

(3) Establish and complete a list of responsibilities related to food safety for members of the Standing Committee of the Party Committee, urge other members of the Standing Committee of the Party Committee to perform food safety-related work responsibilities, and incorporate food safety work into the performance evaluation of local party and government leaders;

(4) Carrying out special research on food safety work, holding party committee meetings or special meetings, listening to special reports on food safety work, studying and solving major food safety issues in a timely manner, and promoting the improvement of the food safety governance system;

(5) Strengthen the building of the leadership team, cadre team and institution building of food safety work departments, and continuously improve the ability of food safety governance;

(6) Coordinating all parties to pay attention to and support food safety work, strengthen food safety publicity, grasp the correct guidance of public opinion, and create a good working atmosphere.

Article 8: The main persons in charge of local governments at all levels shall strengthen their leadership over food safety work in their respective regions, and earnestly implement the guidelines, policies, decision-making arrangements and instructions of the Party Central Committee and the State Council on food safety work. Decisions and relevant laws and regulations, responsibilities mainly include:

(1) Leading food safety work in the region, organizing and promoting local governments to implement food safety territorial management responsibilities;

(2) Adhere to the new development concept, correctly handle the relationship between development and safety, incorporate food safety into the regional national economic and social development plan, government work priorities, and accept the supervision of the National People's Congress and the Chinese People's Political Consultative Conference;

(3) Establish and improve the local food safety supervision responsibility system, clarify the food safety work responsibilities of the government leadership team members at the corresponding level and the food safety work responsibilities of relevant government departments, and guide and urge the government leadership team members and relevant departments to implement their work responsibilities;

(4) Strengthen the construction of food safety supervision and law enforcement capabilities, integrate supervision forces, optimize the supervision mechanism, improve the professional level of supervision and law enforcement teams, establish and improve the food safety financial investment guarantee mechanism, and guarantee the funds necessary for the supervision and law enforcement agencies to perform their duties in accordance with the law And equipment;

Article 9: Other members of the standing committees of local party committees at all levels shall, in accordance with the division of responsibilities, strengthen leadership over food safety-related work in the industry or field in charge, assist the main person in charge of the party committee, coordinate the promotion of food safety-related work in the industry or field in charge, and supervise and guide Relevant departments perform their duties in accordance with the law, and promptly study and solve food safety related work issues in their respective industries or fields.

Article 10: Local governments at all levels in charge of food safety work shall strengthen the leadership of food safety supervision work in the region, and be specifically responsible for organizing food safety supervision work in the region. The main responsibilities include:

(1) Assist the party committee and the main person in charge of the government to implement the responsibility of food safety territorial management, organize the formulation and implementation of the Party Central Committee and the State Council’s policies, decision-making deployment and the spirit of instructions on food safety work, and the decisions and relevant decisions of the superior and corresponding party committees and governments Specific measures of laws and regulations;

(2) Organizing and carrying out special research on food safety work, studying and formulating special plans for food safety in the region, and annual key work plans, and coordinating and promoting food safety work in the region;

(3) Organize and coordinate food safety supervision departments and relevant departments, analyze the food safety situation in a timely manner, study and solve related problems in the food safety field, and promote the improvement of the entire chain of food safety supervision mechanisms from farmland to table;

(4) Organize and promote the establishment of information sharing mechanisms by food safety supervision departments and relevant departments, promote "Internet +" food safety supervision, and continuously improve the efficiency of food safety supervision and modernization of governance capabilities;

(5) Organize and implement food safety risk prevention and control, hidden danger investigation and special management, and resolutely prevent systemic and regional food safety risks;

(6) Organizing the formulation of emergency plans for food safety accidents, and organizing timely response, handling, investigation and handling of food safety emergencies in the region;

(7) Organize and carry out food safety work evaluation and assessment, and urge relevant government departments at the same level and lower-level governments to implement food safety work responsibilities;

(8) Organize and carry out food safety law and science publicity, safety education, and credit system construction to promote the co-governance of food safety in society.

Article 11 Other members of the leadership team of local governments at all levels shall, in accordance with the division of responsibilities, strengthen the leadership of food safety-related work in the industry or field in charge, assist the main person in charge of the government, coordinate the promotion of food safety-related work in the industry or field in charge, and supervise Guide relevant departments to perform their duties in accordance with the law, and timely study and solve food safety-related work issues in their respective industries or fields.

Chapter Three   Assessment and Supervision

Article 12: Local party committees and governments at all levels shall follow up and supervise the implementation of major food safety deployments and key tasks.

Article 13: Local party committees at all levels shall conduct inspections on the performance of food safety duties by local party and government leading cadres in accordance with the arrangements for inspections and inspections.

Article 14: Local party committees and governments at all levels shall give full play to the role of the "baton" in appraisal and assessment, and promote local party and government leaders to implement food safety responsibilities.

Article 15: The results of follow-up supervision, performance inspection, and appraisal should be used as important references for the assessment, rewards and punishments, use, and adjustment of local party and government leading cadres. Local party and government leading cadres who are held accountable for not performing their duties shall be subject to relevant regulations in terms of evaluation, selection and appointment.

Chapter Four: Rewards and Punishments

Article 16   Local party and government leaders who have the courage to act, assume responsibility, perform their duties and fulfill their duties in food safety work, under any of the following circumstances, shall be commended and rewarded in accordance with relevant regulations:

(1) Organizing the prevention of food safety accidents and eliminating major food safety risks in a timely and effective manner, so as to protect the interests of the country and the people from major losses;

(2) Those who have made major innovations and achieved remarkable results in food safety work;

(3) Those who have consecutively performed well in the food safety work appraisal and assessment;

(4) Making other outstanding contributions.

Article 17: Where local party and government leaders have one of the following circumstances in fulfilling their responsibilities for food safety work, they shall be held accountable in accordance with relevant regulations:

(1) Failing to perform the duties and requirements of these regulations, or failing to perform their duties in place;

(2) Taking leadership responsibility for major food safety incidents in the region or food safety incidents with bad social impact;

(3) Failure to promptly organize and lead relevant departments to effectively deal with food safety accidents in the region, causing adverse effects or large losses;

(4) Those who are responsible for the leadership of concealing, misreporting, or delaying the reporting of food safety incidents;

(5) Intervening in violation of regulations, intervening in the handling of food safety incidents in accordance with the law and handling of food safety violations and crimes;

(6) There are other circumstances that should be accountable.

Article 18: Where local party and government leading cadres have the circumstances listed in Article 17 of these regulations, they shall be held accountable in accordance with the cadre management authority, rules, disciplines and laws. Those suspected of job-related crimes shall be investigated and handled by the supervisory organ in accordance with the law.

Article 19: Where local party and government leaders report dereliction of duty in a timely manner and take the initiative to take remedial measures to effectively prevent or reduce major losses in food safety accidents, restore serious adverse social effects, or actively cooperate with accountability investigations and take the initiative to assume responsibilities, they shall be Provisions are made to be lighter and lessen accountability. Where poor work results in a major or particularly serious food safety accident, or has caused serious adverse effects, the responsibility shall be severely investigated.

Chapter 5: Supplementary Provisions

Article 20   Township (street) party and government leading cadres, party and government leading cadres of various development zone management agencies, shall be implemented with reference to these regulations.

Article 21: These regulations shall be interpreted by the State Administration for Market Regulation in conjunction with the Ministry of Agriculture and Rural Affairs.

Article 22: These regulations shall come into force on February 5, 2019.
